BIG SPRING, TX --Two men pleaded Guilty to Racing, Causing Serious Bodily Injury or Death in the 118th District Court in Big Spring on Wednesday, Aug. 18, 2021.
In June 2019, Gary Miers Jr., 42, was in 3-vehicle major auto accident on S. Gregg St. in Big Spring. The other two vehicles were driven by then 19-year-old Dakota Backes, and Mackenzie Powell, then - 22 years old. Law enforcement and EMS personnel responded to the accident. Miers was pronounced deceased at the scene.
Backes and Powell were later indicted for Racing, Causing Serious Bodily Injury or Death, which is a 2nd-degree felony. On Wednesday, both defendants pleaded guilty and received a sentence of 6 years deferred adjudication and a $2,500 fine.
Lindsay Wilkerson, Assistant District Attorney for the 118th District Court, explained that this means that Backes and Powell will be on probation for 6 years, and if they successfully complete the probation then it will be as if they had never been found guilty. If the defendants’ probation is revoked, they will face 2 to 20 years in prison and up to a $10,000 fine.
The family of the deceased was in agreement with this sentencing and was able to read a family impact statement to the defendants.
